By Assignment of Error No. 4, based upon Exceptions Nos. 1 and 7, plaintiff contends that the trial court erred in denying her motion for directed verdict with respect to express trust. Plaintiff argues that the evidence was not clear and convincing that she and Charles held the property for defendants pursuant to an express trust and that the issue should not have been submitted to the jury.
