In May, 1982 plaintiff Olliver/Pilcher Insurance, Inc. (Olliver/Pilcher) filed an action seeking specific performance of a contract with its former employee, defendant Robert G. Daniels (Daniels). The trial court granted Daniels' summary judgment motion, and the Court of Appeals reversed. We granted Daniels' petition for review. Rule 23, Ariz.R.Civ.App.P., 17A A.R.S.
