After a jury trial in Superior Court (York County) Robert Dumont was convicted of unlawful sexual contact, 17-A M.R.S.A. § 255(1)(C) (1983), and sentenced to three years in the Maine State Prison, with one and one-half years suspended. On appeal, he challenges the legality of the sentence, arguing that the sentencing justice deprived him of due process and the right to confrontation by considering and relying on two affidavits in the course...
