The People of the State of New York, Respondent, v. Albino R. Plastini, Appellant

Appellate Division of the Supreme Court of the State of New York, Second Department.

December 15, 1986

Ordered that the judgment is modified, on the law, by reducing the sentence imposed on the defendant's conviction of menacing to three months' imprisonment. As so modified, the judgment is affirmed.

The trial court did not abuse its discretion in striking Mrs. Plastini's testimony inasmuch as the evidence sought to be introduced was not relevant (see, People v Daly, 98 A.D.2d 803, 805, affd
