Appellant, Warren C. Cook, was tried before a jury in November, 1974, for murder, obstructing justice, kidnapping, assault with intent to commit murder, assault with a deadly weapon, and possession of a deadly weapon. The state also alleged prior convictions of aggravated assault and battery. The first trial resulted in a mistrial.
