This action was brought by plaintiff against defendant Fernandez, the winner of a lottery drawing. Plaintiff alleged that he and defendant had contracted to share any winnings evenly in return for certain assistance rendered by him. An initial application by plaintiff for injunctive relief similar to that sought herein was denied on the ground that the money was to be paid over a number of years, and that if plaintiff were successful...
