Plaintiff Interstate Power Company (IPC) brought this action in equity against defendant Dubuque County seeking a declaratory judgment that the utility was entitled to reimbursement for expenses it incurred by reason of a county roadway construction project. Plaintiff's motion for summary judgment was overruled, and the court held that IPC was not entitled to compensation from the county for the costs of raising its electrical transmission lines...
