Defendant, Perry M. Garland, was convicted of simple kidnapping, a violation of R.S. 14:45. He was sentenced on May 21, 1984, and an order of appeal was entered that same day. A multiple bill was filed by the state two days later on May 23, 1984. Three months later, the court found defendant to be a second offender and increased his sentence to five years at hard labor pursuant to R.S. 15:529.1.
