During the early morning hours of July 3, 1984, in Bronx County, New York City Police Officer Patrick O'Connor (Officer O'Connor) arrested defendant for the possession of a loaded .25 caliber automatic pistol. Following his indictment for two counts of criminal possession of a weapon in the third degree (Penal Law § 265.02) and one count of possession of burglar's tools (Penal Law § 140.35), defendant moved to, inter alia, suppress this weapon.
