Court of Appeals of Wisconsin.

Decided December 18, 1986.

Attorney(s) appearing for the Case

For the defendant-appellant the cause was submitted on the briefs of Teresa M. Elguezabel and La Follette & Sinykin, of Madison.

For the respondent the cause was submitted on the brief of Bronson C. La Follette, attorney general, and Daniel J. O'Brien, assistant attorney general.

Before Gartzke, P.J., Dykman, and Eich, JJ.

GARTZKE, P.J.

Ronald Sorenson appeals from a judgment of conviction for first-degree sexual assault. Section 940.225(1)(d), Stats. The complainant is Sorenson's seven-year-old daughter. The dispositive issue is whether sufficient evidence was presented at the preliminary hearing to bind him over for trial. That issue turns on whether the trial court properly admitted hearsay evidence at the preliminary hearing. We conclude that the court erred and reverse.
