This appeal follows a conviction for the offense of capital murder and sentence of death. For the reasons outlined below, the conviction and sentence are due to be affirmed.

On August 3, 1977, the appellant killed L.D. Sizemore, the Sheriff of Geneva County. After a trial by jury, the appellant was convicted of the capital offense and was sentenced to death, but his conviction was vacated by the United States Supreme Court. Cade v. State...
