A key witness in the trial of defendant on burglary charges was not present at trial and the court allowed her sworn statement obtained by county attorney's subpoena to be read into the record. The defendant now appeals, saying the court erred in its conclusion that the deposition should be allowed because the witness was unavailable and other requirements were met of the exception to the hearsay rule found at Iowa Rule of Evidence 804(b)(5...
