SCHOTT, Judge.

Defendant was charged with possession of marijuana with intent to distribute in violation of R.S. 40:966 and was convicted of attempted possession with intent to distribute. The trial court granted defendant's motion to modify the verdict and found him guilty of simple possession of marijuana. On the state's appeal this court reversed the modification, reinstated the verdict and remanded the case for sentencing. State v. Benton,
