The instant motion brought by defendants, Dick Gidron Cadillac and Tony Perez, for an order, pursuant to CPLR 3211 (a) (2) dismissing plaintiff's action on the ground that the court lacks jurisdiction over the subject matter.

The within action was commenced by plaintiff against the defendants for $100,000 compensatory damages and for punitive damages in the sum of $250,000.
