This is the second trial of this matter. Plaintiffs have been the tenants of apartment 2B at 77 West 55th Street since 1966. In 1977, the plaintiffs complained to the then landlord, defendant 77 West 55th Street Associates, about a penetrating noise and vibration in their apartment, particularly in their bedroom.
