HENNESSEY, C.J.
In 1972, the defendant was convicted of murder in the second degree and unlawfully carrying a firearm. In 1984, the defendant filed a motion for postconviction relief, claiming that he had been placed twice in jeopardy contrary to his rights under the United States Constitution and Massachusetts common law.
