George Dailey was charged with and convicted on three counts of capital sexual battery on a child under twelve years of age. § 794.011(2), Fla. Stat. (1985). He was sentenced to concurrent terms of life imprisonment with 25 years minimum mandatory on two counts and 30 years for the lesser included offense of attempted sexual battery on the remaining count.
