This criminal appeal illustrates one way in which an accused who is on bail can waive rights involving presence at trial and thereby can be tried in absentia.

Appellant, Stephen Barnett (Barnett), was arrested without a warrant on February 17, 1984, and charged with (1) possession of heroin with intent to distribute and (2) resisting arrest. Routinely, Barnett would have been served with a copy of the statement of charges when it was prepared...
