The issue herein is whether the recent Court of Appeals decision of People v Anderson (66 N.Y.2d 529 [1985] [amplifying the rules of dismissal of criminal cases for prosecutorial postreadiness delay]) is to be applied retroactively to cases in litigation prior to that decision.
