OPINION

HATHAWAY, Chief Judge.

The state challenges the superior court's denial of appellate relief from the Tucson city court order granting the motion to vacate judgment filed by the real party in interest, Hubert G. DeWolf. Because the issues presented are of statewide importance in the prosecution of drunk driving cases, and in order to avoid inconsistent rulings in the lower courts, we accept jurisdiction.
