The determination of the Commissioner, dated May 3, 1984, found each of the petitioners guilty of a departmental charge and specification after a hearing and dismissed them from their positions as correction officers. They thereupon instituted this CPLR article 78 proceeding. Special Term entertained the petition and granted judgment dismissing the petition instead of transferring the matter to this court.
