This case involves an incident which occurred in The Bronx on May 8, 1982 and resulted in the shooting death of John Johnson, a retired police officer. Defendant herein was indicated for manslaughter in the second degree and, following a nonjury trial, was convicted of criminally negligent homicide as a lesser included offense.
