The People of the State of New York, Respondent, v. Terrance E. Mason, Appellant

Appellate Division of the Supreme Court of the State of New York, Second Department.

December 1, 1986

Ordered that the judgment is modified, on the law, by reducing the defendant's sentence from a term of imprisonment of 1½ to 3 years to a term of imprisonment of 1 to 3 years. As so modified, the judgment is affirmed.

By pleading guilty, the defendant waived his right to contest the denial of his motion pursuant to CPL 30.30 (see, People v O'Brien, 56 N.Y.2d 1009;
