On October 8, 1982, claimant and John Faulkner were inmates at Adirondack Correctional Facility. Both were assigned to an inside ground crew detail which had been given the task of cleaning up an area within the facility. Appropriate tools for the job were provided by the facility. Faulkner obtained a pickax from one of the other workers, disengaged the handle and, without apparent provocation, began to strike claimant about the head and face...
