Petitioner, Luis Lavaris, was convicted of first degree murder while armed with a deadly weapon. His conviction was affirmed by the Court of Appeals, but was reversed and remanded by this court. Lavaris was retried and again convicted of first degree murder. The Court of Appeals again affirmed his conviction.
