LANSING, Judge.

A jury convicted Frank Poppy, Jr. of attempted first-degree murder and first-degree assault of Irene Poppy, his estranged wife. See Minn.Stat. §§ 609.185, subd. 1; 609.17; 609.221; and 609.11, subd. 5. He was sentenced to a term of 70 months with a minimum term of 36 months.
