FACTS

In the instant case, the defendant was arrested at 2:16 A.M. early on Friday morning, August 31, 1984 after his car hit a curb on North Middletown Road, Nanuet, disabling his car. The police investigated and defendant was charged with driving while intoxicated with an alleged blood alcohol content of 17% in violation of Vehicle and Traffic Law § 1192 (2) and (3).
