Ordered that the judgment is modified, on the law and the facts, by deleting the second decretal paragraph thereof, and substituting therefor a provision awarding judgment to the defendant Providence Washington Insurance Company on its cross claim to the extent of holding the defendant Anthony Libardi Insurance liable to the defendant Providence Washington Insurance Company for 100% of losses actually paid and the cost of providing a defense against certain claims.
