HATHAWAY, Chief Judge.

Appellant was convicted by a jury of one count of child abuse involving his 21-month-old step-daughter, and was sentenced to five years in prison.

On June 14, 1986, Child Protective Services, pursuant to a recommendation of a doctor, referred appellant's step-daughter to Dr. Helen Britton for an examination of burns the child had suffered. The child had second-degree burns on her face and left arm. The doctor concluded...
