HATHAWAY, Chief Judge.

Appellant, William Henderson, an investment counselor, and Henderson, Inc., were charged by indictment with four counts of theft over $1,000, a class 3 felony; two counts of attempted theft over $1,000, class 4 felony; forgery, a class 4 felony; illegal control of an enterprise, a class 3 felony; and illegally conducting an enterprise, a class 3 felony. The state also alleged various counts as prior offenses to the other counts...
