OPINION

FERNANDEZ, Judge.

Petitioner challenges the respondent judge's denial of its motion to dismiss the action filed by the real party in interest to foreclose a mechanic's lien. Since petitioner has no plain, speedy and adequate remedy by appeal, and because our granting relief will terminate a substantial portion of the litigation, we assume jurisdiction. Lim v. Superior Court, 126 Ariz. 481,
