Defendant, Terry C. Hicks, was convicted after a jury trial in the circuit court of Montgomery County of burglary and theft, with the latter conviction enhanced to a felony due to defendant's previous conviction for theft. He was sentenced to concurrent terms of 5 years' imprisonment on the burglary conviction and 1 1/2 years' imprisonment on the theft conviction. On appeal, defendant...
