Plaintiff commenced a medical malpractice suit against defendants for alleged injuries sustained during elective cosmetic surgery. Defendants moved for accelerated judgment, pursuant to GCR 1963, 116.1(2) and on the basis that plaintiff had agreed to arbitrate any claims arising out of his medical care. Following an evidentiary hearing, the circuit court concluded that plaintiff had not sustained his burden of proving the invalidity of the arbitration...
