Plaintiffs, Rodney J. and Jane B. Smith, sued defendants, Wayne Dunn, Donald V. "Buck" Schooler, Bob Rickel and Doug Rickel, for damages to their home caused by fire. The trial court granted summary judgment in favor of defendants Bob and Doug Rickel. The Rickels moved the court to award their attorney fees and expenses contending the suit against them was frivolous.
