Appellant was indicted on two counts of rape, R.C. 2907.02. Each count specified (1) the use of force, and (2) that the victim was under thirteen years of age. He was also indicted on one count of gross sexual imposition, R.C. 2907.05, with the specification the victim was under thirteen years of age.
