Defendant-appellee, Barbara Jean Bireley, was indicted and tried for conspiracy to murder in the death of her husband, Dr. Michael Bireley. He was found severely beaten in his Washington Court House home and died of a heart attack one month later in a Columbus hospital. During trial, on defense's case-in-chief, defense counsel asked Sgt.
