HILL, Circuit Judge:

This case is before the court on defendant-appellant Wayne T. Lakes' appeal from the district court's denial of habeas corpus relief sought pursuant to 28 U.S.C. § 2254.

Appellant was convicted of malice murder and sentenced to life imprisonment in Georgia state court in 1979. His conviction and sentences were affirmed by the Supreme Court of Georgia on direct appeal. Lakes v. State, 244 Ga. 217
