This matter comes before the Court to consider the defendant's motion for partial summary judgment on plaintiff's claim brought under 42 U.S.C. § 1981. The plaintiff, Solitaire DiPasalgne, was employed by the defendant, Elby's Family Restaurants, until her discharge on October 19, 1979. The plaintiff alleges that she was discharged because of her race in violation of Title VII of the Civil Rights Act of 1964...
