The State of Idaho charged Craig William Hesse with felony theft. At his initial appearance Hesse requested appointment of counsel, which the magistrate court, following an indigency hearing on January 25, 1984, denied on grounds Hesse was not indigent. The magistrate continued arraignment to January 27, 1984. On that date, Hesse said he had consulted with attorney Gary Lew, who could not attend the arraignment...
