Burlington Northern, Inc. appeals from an order by the District Court of the Eighth Judicial District, Cascade County, granting plaintiff Doug Plouffe's motion for summary judgment on the issue of liability under the Federal Employers' Liability Act (Title 45 U.S.C. § 51 et seq.) and denying defendant's motion for a new trial. We affirm.
