The plaintiff, Dr. Milton Margoles, brought this slander action in 1972 against The Journal Corporation, and Alida Johns, a reporter for the Journal. The district court dismissed the action in 1976, pursuant to Fed.R.Civ.P. 37(b)(2)(C), because of the plaintiff's failure to comply with discovery orders.
