Failure to comply with its obligations under our discovery rules is again the Achilles heel of the prosecution's effort to uphold a criminal conviction. Our rules require that, upon request of the accused, the prosecution must disclose a copy of the past criminal record of the accused, particularly where the prosecution intends to use that record for impeachment purposes.
