This is a purloined-backhoe case. Appellant, Robert Dean Pellatz (Pellatz) was convicted in a jury trial of larceny theft, and brings the appeal from the claimed unconstitutional intrusion without a search warrant, wherein the law enforcement officer determined ownership of the missing equipment by directing a mechanic to climb upon a lowboy semi truck trailer parked in a public parking lot, to locate identification information.
