The defendant, Ricky Prejean, was charged by grand jury indictment with one count of aggravated rape, in violation of La.R.S. 14:42, and two counts of aggravated kidnapping, in violation of La.R.S. 14:44. At trial, the aggravated kidnapping counts were severed and the defendant was tried only on the aggravated rape charge. A twelve-person jury returned the responsive verdict of attempted aggravated rape...
