This is a civil rights suit brought under 42 U.S.C. § 1983. On October 7, 1986, the matter came before the Court on defendants' motion to dismiss, filed September 8, 1986. Defendants seek to dismiss the complaint pursuant to Fed.R.Civ.P. 12(b)(1), (2) and (6); defendants also request that the Court abstain from exercising jurisdiction in this case.
