The criminal offenses involved in this case were as a result of a racial statement directed at two blacks, Jackie Duncan and Kerry Turner; everyone else involved is white. Two or three weeks before, David M. Lejeune ordered Turner out of Irene's Hide-Away Lounge (hereafter Irene's) because Turner was black. On that occasion, Irene, the bar owner, advised Turner to leave to avoid trouble. On July 18, 1982, between 2:00 and 4:00 a.m. Duncan and Turner...
