MEMORANDUM

MERHIGE, District Judge.

This matter comes before the Court on petitioner's petition for habeas corpus relief, filed pursuant to 28 U.S.C. § 2254, which alleges ineffective assistance of counsel in violation of the Sixth Amendment of the United States Constitution. Petitioner is presently incarcerated at Mecklenburg Correctional Center and is under a sentence of death. Petitioner's date of execution has not yet been set.
