Helen McCarthy appeals an order of the Superior Court dismissing her cause of action against the State of Washington Department of Social and Health Services (DSHS) for personal injuries. We hold that McCarthy has stated a claim upon which relief can be granted, and conclude, therefore, that the trial court erred in granting the motion.
