The defendant, John Leago Thomas, Jr., was convicted of attempted reckless manslaughter and first degree assault as the result of a jury trial in Adams County District Court. On appeal, the defendant argued, among other things, that attempted reckless manslaughter is not a cognizable crime in Colorado. The court of appeals agreed with the defendant's argument and reversed the conviction for attempted reckless manslaughter, but affirmed the conviction...
