Steven McLaughlin (hereinafter "defendant") has been charged with driving under the influence of alcohol in violation of 21 Del.C. § 4177 as a result of an incident on March 13, 1984, within the City of Wilmington. At the time of the arrest, the defendant was given a breath test which resulted in a blood alcohol reading of .23 percent.
